Laggard Indian Healthcare System.

The new government is there with the dawn of many new aspirations from all the economical classes of the society. Every society has its own dreams associated with the new government and sans any doubt, this new government has been formed on the basis of dreams only, dreams of people that the new government will assist them in coming up and allocating them the much-awaited lifestyle, the citizens of the nation are demanding. The new government is there because people were fed up of hyperbole and wanted to address real change and that’s why this government needs to be an aberrational and exceptional from the other governments elected to the temple of democracy.

One of the most important things that the whole nation yearns for is a good healthcare system. As the new India is coming into the limelight, the young and rejuvenated nation awaits is better level of living and everyone knows that an upgraded lifestyle can be achieved only through a revamped healthcare system and with better amenities being accommodated to the Indian people.

The current system of healthcare in the whole nation is a ramshackle one with obsolete facilities marked by unworthy officials as well as with lesser efficiency than what is needed. The contemporary system of health management is marked by inefficacies of previous government in handling the most important asset that a nation carries – health of its citizens and owning to all such inaccuracies the current healthcare system of Indian remains most disorganised and haphazard.

The current system that guarantees to safeguard the lives of 1.237 billion can be termed as a stigma on the whole nation. On one hand it’s a boon for the rich and upper middle class while for the lower middle class and the impoverished section, dying on road is much better than getting treated in government hospitals (not all but a majority of them).

Healthcare was never a top priority after independence. The initial onus was on agriculture, infrastructure and military. This led to social sectors like health and education being neglected. In fact, it wasn’t until 1982-83 that the National Health Policy was endorsed by parliament.  Most of the services provided thereon were preventive (vaccinations against various ailments) and very few curative healthcare services were provided. Preventive services were mostly provided by the private sector. Medical education too was neglected, a case in point being that there are no superlative medical institution brands like the IITs or the IIMs. Although the government of India continues to boast of its so-called government hospital’s technology but it’s a true fact that public sector healthcare system continues to be the most preferred one.

Government hospitals continue to be a shame for the whole nation. In the government hospitals today, world worst facilities are being given and on the other hand many malpractices by crooked charlatan doctors like organ smuggling and also inefficiency at treating patients continue to terrorise the pauper patients. Today the doctors employed by the government have their own clinics as well as private institutes and these doctors in collusion with the other authorities continue to exploit the precious life of the patients. Many cases have come out where many patients have lost their life.

Many other cases have been disclosed in which the god of life – the doctors themselves become the harbingers of death who even go on to smuggle the organs of their patients. In the year 2008, Delhi Police busted an organ trade racket in which the merciless doctors had smuggled more than 500 kidneys. The doctors were paying the patients as much less than $1000 and then were selling the kidneys to the needy patients at a rate of $37,500.  India's illegal organ trade is driven in part by the incredible imbalance between supply and demand for legal organs. The Indian government banned the sale of kidneys for commercial gain in 1994; lawbreakers can be jailed for up to five years. But legal organ donations remain rare in India. The Multi Organ Harvesting Aid Network (MOHAN), a Chennai-based non-government group that promotes legal organ donation, puts donation rates in India at well under 1 per million, compared to rates of more than 20 per million in places such as Spain, the U.S. and France and these ruthless doctors continue to exploit this demand and supply problem to make illegitimate money and to debilitate of thousands of people. One more thing is that some doctors even collude with despicable people and even sell children to such people. Boys who are born to poor people are immediately sold to people who want boys and thus some doctors and hospital staffs continue to devoid the children from his or her mother. These are the grass root level problems being faced by a common citizen of India.

The other thing is that we still after 67 years, lack advance technology in medical science for the poor citizens. Many advanced technologies used to cure people are not at all available at government hospitals meant for serving the poor people and that’s why at last poor people are turned away from the hospital.

Although it’s a true fact that India’s biggest and best hospital in AIIMS but it’s also a bitter truth that there is a dearth of beds for the people in various hospitals. In the year 2003 there was 0.9 beds per 1000 citizens of India? Totally ridiculous! And with the dearth of beds there is also a lack of doctors in the whole nation. If we go according to the statistics then in India only 1 doctor is available for treating 1700 patients. Does that make any sense?
Let’s move on to some general topics.

According to a survey by Thomson Reuters, India is the worst place for a mother to survive in the G20 countries. A mother dies every 10 minutes in India. The country is also not very much good for the child growth. Over 1.25 million children died every year in India due to deprivation from a good healthcare system. One more shocking fact is that only 7% children in India receive minimum acceptable diet set up by the World Health Organisation.

The other thing is indifference of government towards this sector. Hitherto the previous government have hardly done anything to help the sector recuperate and this is evident from the fact that India spends only 4.1% of its GDP on such an important sector while on the other hand Brazil spends 9% and USA 17.9% of its GDP on this paramount sector.
All these things continue to show that our healthcare system continues to be a failure. India is not able to produce big talents worldwide just because of this. Health is wealth and if the nation can’t give its citizens health then it should not dream about securing wealth. The new government carries a lot of onus on its shoulder and this is the most crucial one and the new government needs to work on it.

Constructive or Destructive.

As the BJP entered the parliament with a thumping victory and a lion’s share of the total seat in the parliament, all the other major parties, outside NDA were pretty much startled and disheartened to mull over the conclusion to come. Out of these opposition parties who fought fiercely and also in vain against Narendra Modi, Indian National Congress was the first and foremost to do so and obviously it was the most disturbed one when the counting process of the elections was over and now the whole of the congress party in under great heat and also fearing the results of the elections in the future which are sure to go in the basket of BJP because of the visionary and iconic leadership of Mr. Narendra Modi. Congress first time faced such a great victory with Rahul Gandhi leading it and at last after the elections Rahul Gandhi dodged away from everything and even didn’t become the head of Indian National Congress in the parliament and at last when no choice was left, Congress party’s veteran leader Mallikarjun Kharge was made to spearhead the Congress party and now Rahul Gandhi as usual is nowhere to be seen.

But one more thing that has dashed the confidence of Indian National Congress to the ground after being trounced in such a bad way is that this time in the 16th Lok Sabha the Congress Party is not even able to be seated at the place of Leader of Opposition. As far as the law is concerned, any party which wishes to become a leader of opposition must have a clear majority in the opposition parties and should also have the possession of 1/10th seats in the Parliament House but amusing this time Congress doesn’t even clarify the rule of 1/10th seats in the Lok Sabha, Congress presently acquires around 44 seats in the parliament and to meet all the criteria required it needs 11 more MPs in the parliament.  The Congress president Sonia Gandhi on Thursday had written a formal letter to Speaker Sumitra Mahajan, staking claim for the post of the leader of opposition (LoP) in the Lok Sabha. Congress sources said the idea to dash off letter to the Speaker was to test Prime Minister Narendra Modi's commitment  in the Parliament on Wednesday that he would take the Opposition along in all decisions. Though the letter is addressed to the Speaker, the ball is actually in Modi's court as to whether his government concedes or opposes the post to the Congress.

The congress as well as one of its most prominent supporters on this stance like Janata Dal United argues that to form a constructive opposition and to check the misdoings of the Modi Government, the opposition must be strengthened, but I found these things completely baseless. I would like to place a few arguments in this favour.

My first argument in this regard is that the congress party doesn’t qualify for the seat of the Leader of Opposition. Giving this crucial position to leaders of congress party would not be welcomed by parties who are just short of touching the Congress mark. Parties like TMC, AIADMD and BJD are just short of less than 10 votes on exceeding the Congress’ vote tally and if in future these parties form a coalition in opposition then leader of opposition will be changed and this may exacerbate the problem.

The other thing is that parties like Congress try to oppose the ruling party to the hilt in order to stop passing of various bill and this may ultimately lead to the policy paralysis in the parliament leading to huge wastage of money of the taxpayers and passing of some vital bill will be halted leading to inefficacious functioning of the temple of democracy.

The third argument of mine is the “Tit for Tat” policy. There was no such leader of Opposition in the first three Lok Sabhas and again in the fifth, seventh and eighth Lok Sabhas, when the Congress was in brute majority. In those times Congress party was pretty much reluctant to listen to anyone and at this time I believe to lead the nation , the Modi government should listen to everybody but not conceding to the demands of others.

In order to make the government function smoothly, people of the nation rather than the opposition parties must be changed. Congress just suffered for its malpractices and the nation showed it what it’s going to do with those who are not up to the expectations of the denizens of the nation and this is all what’s needed in a democracy.

Endangered Sports In India.

Sports in India is, was and always be the binding thread of the whole nation, a common religion which the whole nation follows ardently and common link which engulfs the whole nation into the fervour of winning and disheartening of losing. Whether the players are hindu, muslim, Christian, sikh etc. but whenever their feet touch the ground and the audience blooms into enthusiasm, all the players discard their own entity and altogether form a team which only has one religion, the religion of nationalism.

If we talk about sports then in India, there are a lot of problems in India related to sports. In India, sports and cricket can be substituted for each other. People think that sports are only limited to cricket and nothing else. We just perceive cricket as the mother of all the sports and that nothing is beyond sports and this notion continues to eradicate the efficiency of India in other arenas of sports.

As the FIFA World Cup 2014 is to be started today, it’s a thing of embarrassment that India can’t even make an appearance at the football gala and not only in football, in other sports too we continue to give bad performances. It’s a pretty derogatory thing that India till now had won only 26 medals at Olympic, a nation of 1.237 billions continue with only 26 medals at Olympics what’s more is that Michael Phelps II of United States, best swimmer of all time, has a tally of 22 medals. Is not that a pretty shameful thing?

But what continues to drive India out of excellence in these sports? A simple answer to problem will be complete indifference shown by the authority and the government towards other sports. Today India continues to field one of the greatest crickets team of the whole world but we still have to cover a long way to go ahead and produce better players in other sports. What’s more painful is that the authorities don’t want other sports to come in the mainstream. This can be made clear from my this example- Indian Hockey team has won around 11 medals at the Olympics but today the condition of the hockey players in India is of poignancy and misery. Today hockey players in India even struggle to make the both ends meets while cricket players continue to earn upto crores for just one match. Not only in hockey India continues to be defeated in games like Tennis, football, basketball etc. just because of two reasons.

The first and foremost reason is the lack of incentive. Indian hockey players, basketball players, volleyball players and many other players continue to be in a very pathos condition just because they are not even paid for playing a game. Controlling boards of these game don’t even have money to buy the players complete branded kit to play against highly efficient teams of the world. Same thing continues to happen with other sports too. In gymnastic, basketball, swimming etc. we are not even have sufficient funds to help our players arrange for simple necessities of the game. Lets talk about football in this matter. Football players today are in worse condition. In places like West Bengal many players who used to be prominent in their times today run errands, distributed newspapers etc., the government is not even ready to help these former players make the both hands meet. This at last shakes the confidence of many budding players who abandon the sports, even some highly talented players at last are forced to leave the game. Today hockey players of India are in an inexplicably bad condition.
The next thing on which I would like to focus on is the lack of infrastructure. Even today there continue to be a lack of stadiums of football, hockey, gymnastics etc. and a dearth of polls for swimming and other sports. This continues to pose serious problems in the way of those who want to play. Today there is a humongous lack of good stadiums of different sports in the whole nation and this prevents children who want to play the sports from playing the game of their choice and at last children are devoid of so many good characteristics just because of that.

In addition to this there is a lack of good sports coaches too. There are only a handful of world standard sports coaches in India, others merely qualify for the high standards and that’s one of the main reason behind India’s 154 position in the FIFA ranking.
Collectively all these problems pose a big threat to the existence of different sports and also to the appearance of India in competitions of various games and if today the government doesn’t scrap away it’s apathetic behaviour then the nation would be at a huge loss.

Taming the dragon.

Modi government, unless the previous government at the Centre, is leaving no stone unturned in erecting and nurturing mutually beneficial international relationships with other countries with special focus on the Asian Countries.

With the commencement of its tenure, the BJP government gave the world governments a cue that it is ready to work with them and develop in the long run a constructive and cordial relationship with them. This was evident from the fact that even before taking the office of Prime Minister Narendra Modi invited political heads of various countries including countries in the SAARC group that it will not waste any further time in developing harmonious relationships with various countries and in finding out solutions to key problems like cross border terrorism, insurgency, illegal immigrants etc. and in this regard now the Modi government wants to waste no time in constructing good and tranquil relationship with its biggest trade and economic partner and its most belligerent antagonist, People’s Republic of China.

In this era, good relations with Beijing are must. Beijing is strategically, politically, economically and also geographically the most important and crucial partner. But one thing that causes problem in between the sweetening the ties is that the dragon continues to remain untamed.
China is a very progressive economy and that’s why it continues to be arrogant with its neighbours. Its recent stance in the Senkaku/Diakokyu islands in Japan as well as its insurgency inside the Indian borders continues to bother India as well as other nations. But China mainly is following the footsteps of today’s developed and powerful nations. It is doing what they did in their own developing years. China now, wants to play a big brother role in the whole of Asia and wants to dominate the economy as well as international polity of the Asian Countries and exert its influence just like the way the USA does. In this manner India needs to make sure that it mitigates the influence of China on other nation. The previous government at the Centre made no discussion with the Chinese government on international topics and trans- border aggression but the Modi government needs to be tough with the dragon or it will engulf the nation. China, through its military insurgencies has been trying to pose a threatening image in front of India. Its military officers continue to terrorise the disputed areas at the Sino-Indo border and now to halt the on-going illegitimate Chinese processes at the border, the newly formed government needs to be tough and direct.

India is also having crossed swords with China over the territory border issues. China, illegitimately continues to exert its ownership on various disputed places like Arunachal Pradesh and continues to flout the rule made under different treaties (Shimla Agreement, actually the Chinese government repudiates to accept the agreement and continues to state that at the time of agreement Tibet decided the boundaries with the British government and therefore the boundaries set at that time can’t be validated). China also defies accepting the McMahon line with India stating that the line has many flaws and doesn’t impress the Chinese government. The boundary issues also escalated pretty much after the defeat of India in Sino-Indian war of 1962 when China beleaguered large amount of lands of India and this further exacerbated the Sino-Indo Chinese boundary issues. Now its high time India mends its boundary disputes with China because if the boundary issues are not settled then both the countries would be at loss with lacunae in the relationships of the two counties. Now if the governments of the two countries get ready to solve the border disputes, then definitely we can achieve a mutually beneficial relationship benefitting the two upcoming world powers.

The other important thing that the new government needs to mull over is the issue of economy. China and India are both going to become world’s largest economy and amusingly China is India’s biggest trade partner. China and India can go ahead a long way in order to become successful and moreover can help each other get ahead. But one thing to focus on is that Chin should not be made to invade the Indian markets. Presently many Chinese small manufacturers producing very cheap commodities are posing a big threat to Indian businesses of products like crackers, toys etc. Indian handicrafts as well as some other important Indian traditional arts are also being threatened for existence due to such cheap goods being made available in the Indian markets and now the Modi government needs to negotiate with the Chinese government to dig out some ways in which the market problem can be tackled.
Now as Chinese Foreign Minister Wang Yi hold talks with Indian foreign Minister Smt. Sushma Swaraj and newly elect PM Narendra Modi and according to the ministry offices there were direct talks on various contentious issues and the talks were cordial and substantive and therefore can pave a new way and landmark paradigm in the relationship of the two countries.


Hope that this time the Indian as well as Chinese relationship go well and that important controversial topics are discussed and sorted out and if we are able to cut way through different problems then definitely the two countries can help each other.

Reviving the education system....

The new government that is going to be formed at the centre is going to be inundated with huge works of reforms and a plethora of expectation. And this time the expectations are going to be highest from the most crucial assets of the nation i.e. the youths.

It would not be a hypocritical thing to mention here that India is a nation of talent and talent resides in the mind of Indian youths and if the nation wants to progress indeed by leaps and bounds then the youth of the nation cannot be snubbed out. Youth of the nation today holds a deluge of expectation from the upcoming and this is evident from the fact that this time more than 150 million have voted in this recently concluded election of 2014. One of the expectations of Indian youth is of a good higher education system.

Today the most challenging problem that the whole Indian subcontinent faces is the lack of a sophisticated higher education system and that’s the main reason why most of the talented youths of India are in US or UK not in India. India’s higher education system nurtures more than 450 million youths of the nation but I am aggrieved to say that the quality education that needs to be allocated to such a crucial generation of the nation is unsatisfactory. Despite of progressing in all other fields of development, India has lacked excessively in reviving the higher education system and now this problem needs to be discussed with utter seriousness.

Today if we talk about good and high levelled institutions in India, then we are definitely facing a dearth of them. To quote an example, I would like to refer to the case of IITs. Every year more than ten lakh students give the Joint Entrance Exam with an aspiration to crack the IITs but what’s ludicrous is that we have only 15 IITs to cater their needs, the other problem that we face today is of a lack of well experienced and good teachers. The level of higher education has become so much uninspiring in India that now it’s pretty difficult to revamp it again, the other thing is of rote learning. Even today in various colleges, marks important more than concept and that’s the point where we are behind the American colleges. If you get to watch an MIT(Massachusetts Institute of Technology)  lecture and compare than with the lecture of an IIT (Indian Institute of Technology), in the very first minute of the commencement of lecture, you would be convinced to say that no Indian institution is better than them. This is the main problem that again we face today. Now our budding engineers are able to unravel contemporary topics and problems but they are not able to create something new and interesting. And what’s more amusing is that we are not having any great institution teaching space science, biotechnology and aeronautical science. No good institution in India teaches these subjects (IIT has recently started teaching these subjects but has a long way to cover to become reliable for the students). Most important subjects like biotechnology have been neglected for a long time till now and this is also one of our worst goof ups.

Today the whole education system of India needs to be renovated if we want to halt the problem of brain drain and to again make sure that Indians get the best of it. Now the upcoming union government needs to effect some radical changes in order to get the best results.
First of all a government funding of educational institution should become a reality. Presently a lot of institutions face the problem of shortage of funding and that’s why these colleges are not able to manage good laboratories and well qualified teachers as per the student’s demand. The government can definitely play a huge role in funding these institutions and channelling them through an untainted governmental body to promote equality among different institution and also to help these institutions raise the bar of their teaching. In this respect we can learn from China which enabled the state funded policies for educational institutions and is now getting great results.

The other thing that the new government can try is of establishing more and more educational institutions in India and also negotiating with some international institutions to have their branches in India so that the Indian students could also see how education is imparted internationally in famous institutions like Harvard, Yale etc. With this the government can also arrange for internationally acclaimed teachers to come and teach at good institutions alike IIMs and IITs.
One more thing is to heavily exploit technology for the betterment of educational institutions. Today so much teaching technology is available through which the dissemination of information can be done easily. We can use a lot of advanced technologies in order to build up a digit environment in the classes to promote understanding of the concept and creativity among students.
If the upcoming government exercises these steps in the education system then a lot can change. We can still carve out a robust education system aimed at producing the highest and the best talents of the world, what we need is tampering of our wrong policies in order to enhance the education system.

A new bud in the plant named India...

Yesterday the whole of the nation saw the dawn of a new epoch, a new era. An era in which mother India has 29 states. The morning of 2nd June, 2014 saw the bearing of the fruit of around 48 years, the date which delivered happiness and extreme ravishment to the people of the new state, the people who have been fighting for the cause of their welfare, for the life of those who sacrificed themselves in order to assert the demands of their people, the remarkable date of 2nd June brought with itself a new son of mother India, the state of Telangana.
The demand for creation of Telangana was ultimately accepted by the Union Government and in the year 2014 the month of June became the harbinger of the prosperity of the people of the state. For a very long time there has been a demand to make Telangana a separate state, carved out of the region of Andhra. Since the very beginning the people of Telangana have been unhappy over the inclusion of Telangana region into the Andhra region. People were angry and resented because the region of Telangana was not getting due welfare and prosperity because of the indifference shown by the various governments in the Andhra Pradesh and this marked the beginning of a new movement in the whole of the nation to carve out a completely new state which would be able to secure welfare as well as prosperity for itself.
Telangana is the largest of the three regions of Andhra Pradesh state, covering 41.47% of its total area. It is inhabited by 40.54% of the state's population and contributes about 76% of the state's revenues including the Hyderabad city revenue (50%), excluding the contribution of the central government. When the central government's contribution to revenue is included, Andhra Pradesh's revenue sources come from Telangana: 61.47% (including 37.17% from Hyderabad); from the central government: 19.86%; from Andhra: 14.71%; and from Rayalaseema: 3.90%. Proponents of a separate Telangana state cite perceived injustices in the distribution of water, budget allocations, and jobs.
 Within the state of Andhra Pradesh, 68.5% of the catchment area of the Krishna River and 69% of the catchment area of the Godavari River are in the plateau region of Telangana and flowing through the other parts of the state into bay of Bengal. Telangana and non-coastal parts of Karnataka and Maharashtra states form Deccan Plateau.
The share of education funding for Telangana ranges from 9.86% in government-aided primary schools to 37.85% in government degree colleges. The above numbers include the expenditure in Hyderabad. Budget allocations to Telangana are generally less than 1/3 of the total Andhra Pradesh budget. There are allegations that in most years, funds allocated to Telangana were never spent.
 Proponents of a separate Telangana state feel that the agreements, plans, and assurances from the legislature and Lok Sabha over the last fifty years have not been honoured, and as a consequence Telangana has remained neglected, exploited, and backward. They allege that the experiment to remain as one state has proven to be a futile exercise and that separation is the best solution.
If we watch the situation carefully then the creation of the new state of Telangana is in itself a very remarkable move. A state could only progress if its people are happy under a regime. If the people of the state remain unhappy and fell unsecured about their present and future, then that state could hardly function ever. A state is indeed nothing but a collection of large group of people and if the state can’t even safeguard the interest of these people then, it’s rules definitely need to mended and tampered to suit what’s best for the people of the state or if these things are not done then at last the state will itself vanish out in the pages of history and that’s why I believe that the creation of the state of Telangana is a good move in all.
The state of Telangana for a very long time has been neglected and snubbed out of progress. If we go according to the figures then 20% of the total Government employees, less than 10% of employees in the secretariat, and less than 5% of department heads in the Andhra Pradesh government are from Telangana; those from other regions make up the bulk of employment. Even Chief Ministers from the Telangana region have never done anything to carry out progress work in the Telangana region. And this at last led to the protests by people which ultimately led to the crafting of a completely new state which would now be able to prosper, progress and produce for its own benefit and for the happiness and welfare of its own people.
Telangana has been made after a lot of struggle from the people of the state, some even killed themselves. The state has been the expectation of people for more than 40 years and now when it has been born, what we have to see is that this dream doesn’t cripple down and there now the whole India needs to unite to help this new state climb up the ladders of success.

Article 370-A curse.

The father of Indian constitution, with utter disappointment and resentment remarked” You wish India should protect your borders, she should build roads in your area, she should supply you food grains, and Kashmir should get equal status as India. But Government of India should have only limited powers and Indian people should have no rights in Kashmir. To give consent to this proposal, would be a treacherous thing against the interests of India and I, as the Law Minister of India, will never do it”. These words truly exhibit the fury engraved in his heart. But do you know on which issue Dr B.R. Ambedkar proclaimed this statement? He averred this statement on the issue of Article 370, the issue that dismayed his more than anything else, even more than the issue of casteism prevalent in Indian subcontinent at that time in the history.
Article 370 continues to be a menace for the whole nation. Just due to this article, there are continuous terror strikes, revolts by separatists and ultimately leading to perturbation and exploitation of the people of the valley. Various authorities like the Central Government, Indian military etc. continue to be feckless in safeguarding the people of the valley just due to this reprehensible act. Kashmiris continue to suffer from insurgency of Pakistani terrorists just due to this act. Unfortunately Kashmir continues to be viewed separately from India just due to this act. So can this act be considered as a tool for the empowerment of Kashmir? I strongly oppose such a notion.
Today the whole nation is undergoing a heated debate, on whether the Article 370 should be revoked or not and I believe that the whole nation except some non-secular and anti- Indian forces, wants its revocation. When the Modi government rolled out its vision of abrogating the Article 370, political parties of Kashmir with its heads (Omar Abdullah and Mehbooba Mufti) and even the Indian National Congress tried to defame the Modi government and Mr. Omar Abdullah, Chief Minister of Jammu and Kashmir, even went on to threaten of dire consequences involving Kashmir separating away of Kashmir. Isn’t that ridiculous that a Chief Minister comes and threatens the Central Government that if it doesn’t comply their demands, then he or she will just segregate their state out of Indian union? But according to me it’s not Mr Abdullah’s fault. He is there in a dilemma. A dilemma whether the Kashmir is his parental state or the Act his parental property. So let me clear out his dilemma, Mr Abdullah has no ownership of the state but yes this despicable Article 370 is his parental act, whose main player was his own grandfather Mr Sheikh Abdullah.
To unravel the Article 370, first of all we need to understand its making.
Article 370 is a brain child of Sheikh Abdullah in which he tricked the former Prime Minister of India Pandit Jawahar Lal Nehru.
After India got independence from British rule, all the princely states had with them three choices. The three choices include- Union with Pakistan, Union with India or becoming a sovereign state. At that time more than 565 princely states assimilated in India but Kashmir continued to dodge the proposal to unify with India in a dream to become a sovereign state. But then in no time, Pakistani troupes attacked Kashmir. Rattled by the sudden assault by the Pakistani army, Maharaja of Kashmir agreed to sign the instrument of accession on the condition that India will protect it from Pakistani army. India fulfilled its promise and made the Pakistani insurgents recede out of the valley. After that came Sheikh Abdullah. In order to prevent Kashmir from becoming an integral part of India, Sheikh Abdullah played a strategic trick in which he proposed that Kashmir was still not ready to become a part of India because one third of the Kashmiris had their occupations in Pakistan and also referred to the situation of distress in the valley at that time and this finally led to the creation of the article 370.


Sheikh Abdullah played a huge role in the framing of Article 370 and at that time Pandit Jawahar Lal Nehru also gave him the authority to draft the article. Very much unfortunately Sheikh Abdullah also included a very mean act in the article, which said that the said article can’t be revoked until and unless the revocation gets the concurrence of Jammu and Kashmir assembly. When the text of Article 370 was finalised, Pt. Nehru induced Gopalaswamy Ayyangar, IAS officer, in the process, as a minister without portfolio to help the Prime Minister deal with the Kashmiri portfolio and get it passed in the Parliament of the nation.


The article met with hugely bolstered opposition in the parliament of India. Many prominent leaders opposed it tooth and nail but at last Mr. Nehru asked Sardar Patel to do something and then Sardar Patel, despite of his own disliking of Article 370, convinced all the leaders to vote in support of the article and unfortunately this article was included in the constitution. But even after its induction many leaders continued to loathe the article. This is evident from the fact that Dr. B.R. Ambedkar even refused to debate on the article 370.
At that time Jawaharlal Nehru promised the nation that the Article 370 was a temporary act and will be abolished after some time but the article continues to hinder the Kashmir from becoming a part of India even after 60 years. What can be more shameful than that?


Today all the problems in Kashmir valley continue to take place just due to this act only. Kashmir continues to be a hotspot of terrorist activities just due to this act and still now some people are against the debilitation of this act.
According to article 370, the Central Government can make laws only with concurrence of the State government, practically giving it the Veto power. Article 352 and 360 for declaration of national and financial emergency respectively cannot be applied in the valley of Kashmir just due to the existence of Article 370.


While a citizen of India has only Indian citizenship, Jammu and Kashmir citizens have two citizenships.

 Anti-Defection Law is not applicable to Jammy and Kashmir. No outsider can buy property in J&K state.

The beneficial laws such as Wealth Tax, Gift Tax & Urban Land Ceiling Act and intermarriage with other Indian nationals do not operate in J&K State. Even Article 356 under which President of India can impose his rule in any state cannot be enforced in J&K without consent of the Governor who himself is an appointee of the President.

State of J&K can refuse building of any cantonment on any site or refuse to allot land for defence purposes.

All these things continue to exacerbate the condition of valley and abetting the terrorists as well as other anti-nationalists forces operate in the state. Just due to this act, our Kashmiri brothers and sisters are not safe in their own state. Insurgents continue to cut a swathe through the valley just due to this law. Pakistan continues to exert its rights on the state just due to this act. The act which was temporarily made has now been transformed to a permanent one by various people just for political gains.

What’s more is that Kashmir continues to viewed as a separated state from India in the eyes of international community just due to this act.

Article 370 should met with completely antagonistic stance by those who love their motherland and those who consider Kashmir as an integral part of the nation while those who try to take advantage of this act just for their political gains should realise the fact that motherland is greater than any politics or position.
