Since 16-December-12 India has been watching a slew of people ranting slogans "Respect Women" etc. and there has been a huge gale of protests in the whole India. I too respect all these things. People have been protesting in order to make all these things come to a halt. In its history India has never observed such an immense protest having a motto of curbing the sexual crimes against the women.
All these things are good that people are rising up and emerging in the limelight to stop such things. But as we all know yesterday Pakistan exhibited a very vicious and macabre act crossing all the limits of barbarity. Pakistani soldiers sneaked inside the Indian territory and killed our two jawans. They even beheaded one of the soldier and took away his head. Many questions were raised that how Pakistani soldiers entered into indian territory covering such a long distance and even slayed down our two officers. How could such an indian take place? Its very shameful. But the more shameful thing is there is no big protest against such a cruel thing in India. Hasn't the resentment of Indians been raised by such a big matter. For a gang rape incident the whole India can come on roads in such a chilly biting weather but against such an act of cruelty no one is coming out, no one is emerging out. This is a really very very shameful thing.
The other thing for a long time big and prominent newpapers in India like Times Of India and Hindustan Times have been conducting several programs so as to ameliorate the friendship between the India and Pakistan, but today it has been proved that all the attempts were futile.
Hindustan Times in a very foolish and absurd act proffered the architect of Kargil War, the notorious Pervez Musharraf to speak in HT Leadership Summit. Musharraf in HT Leadership Summit also proclaimed that he doesn't regreat the Kargil War.
Times of India has been running an initiative named "Aman Ki Aasha". This initiative aims at enhancing the Indo-Pak relationship, but now Pak has portrayed its real face towards India. But still TOI prints in the newspaper that both the nations need friendly talks and understanding and also posts a quoted by Ralph Waldo Emerson " Peace can't be achieved through violence, it can only be attained through understanding". Even after such a barbaric act they are expecting India to be friendly. Pakistan has been continuously violating the ceasefire rule and is not ready to maintain good relations with India so why is Indian media trying to maintain good relations with Pakistan. People can't be maintained from only one side, both the sides have to be equally wary and careful otherwise nothing can be done and with such a brutal and bad nation India needn't maintain any relation. The country which pampers terrorism against India can't be India's friend and pal. Pakistan doesn't deserve India's friendship and is not worth of it.
Indian government should raise the matter at International forums and need to deem the matter as a very big and urgent one.

A VICIOUS ACT BY PAKISTAN



 

Yesterday the whole India's harmony was perturbed. The harmony of the in toto country was completely debilitated by the Pakistani soldiers attack. Every Indian was disturbed by the vicious act of the Pakistan Army. Yesterday Pakistani soldiers in order to help the terrorists infiltrate in the Indian territory commenced a skirmish with the Indian military.  But the skirmish turned into a ferocious.
Yesterday Pakistani soldiers, in an attempt to help the terrorists infiltrate into the Indian territory, clashed with the Indian soldiers. The Pakistani Soldiers crossed the Indian LoC (Line of Control) fence and sneaked into the Indian territory upto 500-600 meters and indulged into fight with Indian soldiers. Although Indian soldiers made this attempt of Pakistani soldiers futile but Pak Soldiers committed a very inhumane and cruel act at the border. The Pak Soldiers slayed down two Indian soldiers and mutilated their body. They even beheaded one of the Indian deceased soldiers and took his head with them. Such a brutal behaviour is not even done by the animals. Its very horrifying that Pakistani Soldiers entered into the Indian territory and gunned down our two soldiers so viciously.
 For a long time India has been trying to enhance the Indo-Pak relations but this ruthless act has affronted the efforts of Indian government and have shown that our all attempts were in vain and sans any fruition. 

Since 2003 there has been an official ceasefire at the Indo-Pak border but Pakistani army has been challenging the ceasefire and has not been following the laws. In 2012 upto 71 infiltration and their infiltration in 2013 has also started. Is this a good code of conduct?
The other thing, lets come to the blunders being done from the Indian side.
The act was a completely premeditated act and Indian military was notified about such plots of Pak army. The government of India knew that Pak soldiers can indulge in such activities. But the army as well as Indian government didn't do anything.
The other thing, last year Pakistani army tried to help the terrorists infiltrate in Indian territory and breached the ceasefire at the border 71 times but the Indian government didn't raised such a big and considerable matter at the International Court of Justice.

This is a very big matter to be considered and Indian government should now moot the matter in the International Court of Justice and such inhumane tasks should not be tolerated anymore.
Hope that the matter will be discussed and such things wouldn't happen again.

Need to do something.

Some days ago the male companion of Nirbhaya, Munirka bus gang rape victim came live on ZEE TV, an indian news channel and let the cats out of the bag. He made many shocking revelations. These shocking revelations challenged every indian. He told that the girl and the boy were naked when they were dumped out of the bus. People use to come on bikes, scooters and cars, used to slow down and then passed away. They kept asking for help but no one came. This clearly portrays how much vigilant and good Delhiites are. No one came out to assist them. After that the boy called the Police control room and after half an hour three PCRs came. After half an hour, is this the service that is being rendered  and allocated to the people of India. In such  brutal crime the police reached  the place after half an hour. This shows our one of the biggest lacunae in tackling the crimes. Our police is reluctant to deal with the crime. If our protectors are not protecting and safe guarding us then crime will definitely took place. How can you talk about curbing the crimes when your system is not willing to help the victims. It replenishes every indian's body with shame. The police came half an hour late, but there is something else too. The other thing is three PCRs which arrived on the spot started arguing with each other. The cops started arguing on some trivial matters and said that his case doesn't come under their police station, the other policemen also averred the same thing. After wasting so much crucial time, one PCR got ready to take the two victims to the hospital but the policemen rebutted to put the girl in PCR. Her male pal despite of his wounds lifter her up and made her sit into the PCR.
Isn't that truly shameful?  Delhi police's motto says, " Citizen first". But is this true? Completely NO. How can the people who ever repudiated to put a victim into the PCR, protect the people? How can they safe guard the people when they are reluctant to help the victims. This is completely shameful.
The government needs to do something on this issue otherwise crime will exhibit a huge surge and we will not be able to do anything.

Need to look at it.

The Munirka gang rape has galvanised very huge and immense protest from all over the India. The dreadful and scandalizing night of 16 Dec 2012 has given a clarion call to the people of India and a tempest of protests for the security of women have been commenced. Now people have got the caveat that this is the high time and the most opulent time to protest against the rampant barbaric works being happening against the women of country. The acts of immeasurable cruelty against women while involve rape, teasing, molestation etc. would not be tolerated any more. The youth generation of India is rising up and is challenging the odds of the society. This type of protest for the safety of women has been there in India first time. Its very relishing that our youths are fearful of nothing and are not going to be deterred by anything that comes in their way. The dereliction of duty by anyone in power would not be endured anymore.


All these things are very good but we are definitely lacking somewhere. The thing is our juvenile act. Out of the six gang rapists one was a minor. While other rapists have been given death panelty, this bloody one has not. Many other case of crimes being done by minor culprits are rising up.
In a recent case a minor boy raped and killed a 6 year old girl and cut her body pieces and throw them in public toilets but was ot awarded death sentence. High Court of India set aside his conviction considering him a juvenile under the eye of law. Was this a justice? Is this fair? Many cases are coming up in which the main culprits are the juveniles. And because these minor culprits are not given stiff punishment there is a huge surge in the juvenile crimes.

Our lawmakers considering all these things have a need to enact law which can give stiff punishment to these people otherwise brace for a bad tomorrow.

A great and legal weapon for people of India.

It may be in toto true that the contemporary indian politicians are not shrewd and good law makers, but still because of our great, brainy and sagacious leaders we are having very good and great laws. Considering the ups and downs of Indian economy, judiciary, politics they promulgated our great and world's biggest written constitution.
The constitution is the most robust and vigorous document of India and is above all. It defines the powers of everyone and proclaims the rights of people, their fundamental duties and everything that we need. Our progenitor have inscribed and penned down the whole country in our constitution. Our greatest constitution on one side restrains anyone from misusing the power and on the other side gives the people of India the rights that they need.
Constitution of India allocates various rights to the people of India which are as follows;-
1. Right to equality
2. Right to freedom
3. Right against exploitation
4. Right to freedom of religion
5. Cultural and Educational rights
6. Right to constitutional remedies

Constitution of India under Right to Freedom also accommodate the people of India the right to protest and say what they want and in this respect article 39A of Indian constitution is wonderful.
 The issue of Public Interest Litigation (PIL) has been enshrined in the article 39A of Indian constitution. This PIL is one of the best and most powerful weapon that a common person, a pauper, a bourgeoisie man has.
"Public Interest Litigation means a legal action initiated in a court of law for the enforcement of public interest or general interest in which the public or class of the community have pecuniary interest or some interest by which their legal rights or liabilities are affected."
Public Interest Litigation's explicit purpose is to alienate the suffering off all those who have borne the burnt of insensitive treatment at the hands of a fellow human being. Transparency in public life & fair judicial action are the right answer to check the increasing menace of violation of legal rights. Traditional rule was that the right to move the Supreme Court is only available to those whose fundamental rights are infringed."----According to Black's dictionary.

PIL eneable a person to file a litigation in public interest so as to take things into the consideration of court. A PIL can be filed free of cost. Even a letter sent to the CJI( Chief Justice of India) is deemed as a PIL and if the matter is of considerble significance the matter is judged and aribitrated.

According to the guidelines of the Supreme Court any member of public having sufficient interest may maintain an action or petition by way of PIL provided: -

» There is a personal injury or injury to a disadvantaged section of the population for whom access to legal justice system is difficult,

» The person bringing the action has sufficient interest to maintain an action of public injury,

» The injury must have arisen because of breach of public duty or violation of the Constitution or of the law,

It must seek enforcement of such public duty and observance of the constitutional law or legal provisions.


How to file a PIL:
 
A PIL may be filed like a write petition. However, in the past the SC has treated even letters addressed to the court as PIL. In People's Democratic Union vs. Union of India, a letter addressed by the petitioner organization seeking a direction against the respondents for ensuring observance of the provisions of famous labour laws in relation to workmen employed in the construction work of projects connected with the Asian games was entertained as a PIL.
The SC has encouraged the filing of PIL for tackling issues related to environment, human rights etc.

Hope that people of India will use this weapon for the benefit and upgradation of country.

PONDER ON IT.

            




For a very long time there has been a humongous and immense protests in Delhi. Delhiites have been there on the streets protesting against the gang rape of 23 year old Nirbhaya. People are there shouting slogans saying "We want Justice".  The rapists have been awarded death panely but the government has not enacted or promulgated any stiff or good law for the welfare of people. People are there protesting for the deceased girl. Everyone in this India is shocked and horrified by the rarest of rare rape case. The girl was brutally beaten, raped by the rapists and that's why the people now wants the government to do something for the welfare of people. But nowadays after the break out of protest and sudden outcry the rape incidents are soaring. This means that our system has not been able to learn from the incident. Our police has been a very reluctant authority in doing anything. Sometimes the policemen refuse to lodge the FIR, the other time it goes to the area where the incident took place very late. Even in Nirbhaya's case the police went to the area where it all happened very late. This exhibits police's procrastination in dealing with crimes.
Again a case of rape has emerged, where a 17 year old girl was raped by two MNCs. The girl was depressed due to her family. Soon she became friend of two people on Facebook and thought that she has got real friends. Then they asked her to meet them and took her to a party and mixed something in her drink and raped her.
My question is why is there a regular hike in rape cases? Why are people not respecting the women? Why are women being made the victims? This is completely very horrifying and bad. Our society is falling in the ditch of despair.
People have to be more vigilant. If there is something bad happening in front of people they never pay heed to the crime and go away. People have to understand, they have to do something.
We have to come ahead and teach the youths to respect women.

Bye Bye 2012

A very very happy new year 2013 to all the readers. May this new year annihilate and obliterate all your sorrows and problems and help you shine and emerge out with flying colors.

As the new year 2013 has started so we all should celebrate it. 2012, one of the most controversial year has terminated. The year which saw many turmoils and conundrums around the globe but we are going to talk about various situations that took place in India during this year.
Various big events happened in India.

The Munirka gang rape case: a 23 year girl was brutally and savagely gang raped by six inhumane men. She was then beaten very severely and was then dumped. The rape took place continuously for 40 Minutes in a moving bus. The incident shocked the whole world and exposed and revealed the inefficacy of Delhi Police, Delhi Traffic Police, Delhi and Central Government and disclosed how much we people respect the women. The case had a devastating effect on the country and the whole country got scandalized by the brutality of the case. Thousands of Indian resorted to protests on India Gate, Jantar Mantar and many other places and shown their fury towards the authorities.

 Narender Modi's victory: Recently the Gujarat assembly polls took place. There were many speculations that Gujarat Veteran leader Keshubhai Patel and Congress Party in Gujarat. But Narender Modi seemed unfazed by all the predictions and secured a clear victory in Gujarat and completed his hat-trick in Gujarat. Modi gained a humongous number of votes and shown the whole world that Hard-work pays. Even NCP ( National Congress Party) and leader and Member of Parliament Mr. Praful Patel lauded Mr. Narender Modi and said that he has given people of Gujarat new technology, business and that's why people have chosen him as their leader. He is in my perspective the most opulent person to lead the country as the Prime Minister. The country will definitely progress by leaps and bounds is Modi becomes the PM.

Assam Riots: In 2012 the whole India saw the bad effects that Social Media can give us. Some unethical people tampered and altered some photos and then posted them on the Facebook and many other social media sites and rumors were aired that North eastern people are being killed. Many North Eastern people fled from different places to go to their native state. Police faced a lot of problems in restoring and the tranquility of the country faced a very huge shock and portrayed us our unpreparedness in dealing such matters.

New introduction: The government of India announced slew of new reforms  like FDI, direct cash transfer system. Some of the projects got a huge amount of protests while some are still not implemented.

India gets a new President: India got its new president in 2012. The UPA candidate for the Presidentship MR. Pranab Mukherjee won the Rashtrapati Bhawan's race. He is an honest, good and worthy person for the concerned position. He is an experienced man and can lead country in a wonderful way and can be a trendsetter for other presidents to come. Good luck sir.

Bail of Surjeet Singh: Pakistani forces released the Indian prisoner Mr. Surjeet Singh after 30 years of imprisonment. First Pakistani government proclaimed that its going to release Sarabjit Singh, whose release Indian government has been wanting for a long time, but suddenly at the eleventh hour they said that they were talking about Surjeet Singh and shocked the whole country.

London Olympics: India immensely improved its medal tally this time and did the best it had ever done. India got six medals and was ranked 55 in medal tally.

26/11 attacker hanged: The inhumane 26/11 attacked Ajmal Aamir Kasab was hanged in the year. This brutal person killed hundreds of innocents just for some bloody people. This brutality was very bad and horrific. The attacks completely shattered the whole India's belief that they are safe. The masterminds behind the attack should also be hanged.
